Merchants and their customers

Picnic Pie is a platform that lets businesses ("Merchants") run their own online stores. People who shop with or sign up at a Merchant's store ("Customers") are customers of that Merchant.

If you sign up or place an order through a Merchant's store, you are providing your information to that Merchant, and you agree that Picnic Pie will make it available to that Merchant so they can manage your account, fulfill your orders, and contact you. Picnic Pie hosts and processes this information on the Merchant's behalf. Your information is available only to the Merchant you signed up with. It is never provided to other Merchants, third parties, or affiliates.

Any marketing consent you give, including consent to receive text messages, is given to that Merchant only. It is not transferred to or shared with any other Merchant, third party, or affiliate, and Picnic Pie does not use it to market to you.

What data do we collect?

Picnic Pie collects the following data:

• Personal identification information (Name, email address, phone number, etc.)
• Information on purchases through our website.
• Information on the store you set up through our website, including but not limited to business name, business address, items sold, item images, etc.

How do we collect your data?

You directly provide Picnic Pie with most of the data we collect. We collect data and process data when you:

• Register online or place an order for any of our products or services.
• Voluntarily complete a customer survey or provide feedback on any of our message boards or via email.
• Use or view our website via your browser's cookies.
• Provide your information to us or complete survey for us at trade shows and other in-person events.

How will we use your data?

Picnic Pie collects your data so that we can:

• Process your order and manage your account.
• If you are a Merchant, send you emails about Picnic Pie's own products, features, and offers, where you've opted in.
• Deliver the transactional and marketing messages Merchants send to their own Customers who have opted in with them.
• Improve our platform for better functionality.

When Picnic Pie processes your order, it may send your data to, and also use the resulting information from, credit reference agencies to prevent fraudulent purchases.

How do we store your data?

Picnic Pie stores your data on servers operated by DigitalOcean, LLC, located in New York. We take reasonable technical and organizational measures to protect your data, including encryption of data in transit using TLS, encryption of data at rest, access controls that limit employee access to what is needed to do their job, and regular backups. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

We retain your data for as long as needed for the purposes described in this policy:

Who has access to your data

Picnic Pie uses your data only in the limited circumstances described below. We never rent, trade, or otherwise provide your personal data to third parties or affiliates for their own marketing or other purposes.

Service providers. We use a small number of service providers to operate our platform. They process data solely on our behalf and under our instructions, may access it only as needed to deliver their service to us, and are contractually prohibited from using it for their own purposes:

• Hosting and infrastructure: DigitalOcean, LLC stores our application data and databases.
• Payment processing: Stripe, Inc. processes payments and handles card details. We do not store full card numbers on our systems.
• Email delivery: Mailgun delivers transactional email such as order confirmations and password resets, Picnic Pie marketing email to Merchants who have opted in, and marketing email that Merchants send to Customers who have opted in with them.
• SMS delivery: Twilio delivers transactional text messages such as order confirmations and delivery notices, and marketing text messages that Merchants send to Customers who have opted in with them.

Mobile information and SMS opt-in data and consent will not be shared with any third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Merchants. If you are a Customer, your information is available to the Merchant you signed up with or ordered from, as described in "Merchants and their customers" above, and to no other Merchant. If you are a Merchant, the information you publish, such as business name, address, item listings, and images, is displayed publicly to shoppers.

Legal and safety. We may disclose data where we are required to by law, or where we reasonably believe disclosure is necessary to enforce our terms, investigate fraud, or protect the rights and safety of our users.

Marketing

Marketing by Picnic Pie. Picnic Pie markets only to Merchants. With your permission, we will email Merchants about our own products, features, and offers we think they'll find useful. We ask for consent when you sign up, and you can change your mind at any time. Picnic Pie never sends marketing text messages, and never markets to Customers of Merchant stores.

Every marketing email includes an unsubscribe link, or you can update your preferences in your account settings or email us at support@picnicpie.app. Opting out of marketing does not stop transactional messages such as order confirmations, security alerts, and service notices which are necessary for us to run your account.

Marketing by Merchants. Merchants may send marketing emails and text messages to Customers who have opted in with that Merchant. These messages come from the Merchant, and the Merchant is responsible for them. Consent you give to one Merchant applies only to that Merchant.

Text messages. If you opt in to text messages from a Merchant, message frequency varies. Message and data rates may apply. Reply STOP at any time to unsubscribe, or HELP for help. Your phone number and SMS opt-in data and consent are used only to send you the messages you agreed to receive from that Merchant, and are never shared with other Merchants, third parties, or affiliates.

Advertising. We may advertise Picnic Pie to businesses on other websites and platforms, including Google and Meta. To reach the right people, we may provide a hashed, non-readable version of a Merchant's email address to these platforms so they can show our ads to that Merchant or to businesses with similar interests. These platforms act on our instructions and are not permitted to use these details to market their own products. Customer contact details, phone numbers, and SMS opt-in data are never used for this purpose. Merchants can opt out by emailing us at support@picnicpie.app, and can also control ad personalization in their Google and Meta account settings.

We do not give your contact details to other companies for them to market their own products to you.

What are your data protection rights?

Picnic Pie would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

The right to access - You have the right to request Picnic Pie for copies of your personal data. We may charge you a small fee for this service.

The right to rectification - You have the right to request that Picnic Pie correct any information you believe is inaccurate. You also have the right to request Picnic Pie to complete the information you believe is incomplete.

The right to erasure - You have the right to request that Picnic Pie erase your personal data, under certain conditions.

The right to restrict processing - You have the right to request that Picnic Pie restrict the processing of your personal data, under certain conditions.

The right to object to processing - You have the right to object to Picnic Pies processing of your personal data, under certain conditions.

The right to data portability - You have the right to request that Picnic Pie transfer the data that we have collected to another organization, or directly to you, under certain conditions.
